Terms of Service

1. Acceptance of terms

By creating a Pulse account or using the Pulse platform, you agree to these Terms of Service and our Privacy Policy. If you're signing up on behalf of a club, you confirm you have the authority to bind that club to these terms.

2. Description of service

Pulse provides member management, scheduling, payment collection, and related tools for sports clubs, provided on an "as is" and "as available" basis. Features and pricing tiers are described on our pricing page and may evolve over time. We do not guarantee uninterrupted or error-free operation of the service.

3. Accounts and responsibilities

You're responsible for keeping your account credentials secure and for all activity under your account. You are solely responsible for the accuracy of the information you enter, including member data you choose to store in Pulse, and for having the legal right to collect, store, and manage that data (including any consents required from members or their guardians).

4. Payment terms & fees

Subscription fees are billed according to the plan you select and are non-refundable except as required by law. Payments collected from members flow directly to the club's own Stripe account; Pulse charges a platform fee on those transactions, disclosed transparently on our pricing page. Stripe's own processing fees apply separately, and Pulse is not responsible for Stripe's acts, omissions, or availability.

5. Acceptable use

You agree not to use Pulse for unlawful purposes, to misrepresent your club or its members, to attempt to access data belonging to another club, or to interfere with the platform's normal operation.

6. Data ownership

Your club owns the data you enter into Pulse. We don't sell club or member data, and you can export your data or close your account at any time. You are responsible for maintaining your own backups of critical data.

7. Disclaimer of warranties

Pulse is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.

8. Limitation of liability

To the maximum extent permitted by law, Pulse and its founder, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of revenue, profits, or data, arising from your use of the platform. Our total aggregate liability for any claim arising out of or relating to these terms or the service will not exceed the fees you paid to Pulse in the twelve (12) months preceding the claim. Nothing in these terms limits liability where it cannot be excluded by law.

9. Indemnification

You agree to indemnify and hold harmless Pulse, its founder, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from: your use of the platform; data you enter or store in Pulse, including member data; your violation of these terms; or your violation of any law or third-party right, including privacy laws applicable to your club's members.

10. Force majeure

Pulse is not liable for any failure or delay in performance resulting from causes beyond our reasonable control, including outages at third-party providers (such as Supabase, Stripe, or Resend), natural disasters, or other events of force majeure.

11. Third-party services

Pulse integrates with third-party services (including Stripe for payments and Resend for email). Your use of those services is also subject to their own terms, and Pulse is not responsible for their performance, security, or availability.

12. Termination

You may cancel your account at any time, with no long-term contract. We may suspend or terminate accounts that violate these terms, with or without notice, at our discretion.

13. Governing law & disputes

These terms are governed by the laws of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any dispute arising from these terms will be subject to the exclusive jurisdiction of the courts of the district of Quebec, Quebec.

14. Changes & contact

We may update these terms from time to time; continued use of Pulse after changes means you accept the updated terms. Questions: support@pulse-club.app.
